ਨਿਆਂ ਪ੍ਰਣਾਲੀ ਦੀ ਦੁਰਵਰਤੋਂ ਰਾਹੀਂ ਲੋਕ ਸੰਘਰਸ਼ਾਂ ਦੇ ਆਗੂਆਂ ਅਤੇ ਜਮਹੂਰੀ ਹੱਕਾਂ ਦੇ ਕਾਰਕੁਨਾਂ ਤੇ ਹਾਕਮਾਂ ਦਾ ਖੂੰਖਾਰ ਹਮਲਾ !

ਹਾਕਮਾਂ ਤੋਂ ਵੱਖਰੇ ਵਿਚਾਰ ਰੱਖਣਾ "ਦਹਿਸ਼ਤਗਰਦੀ "!ਜ਼ਿੰਦਗੀ ਅਤੇ ਆਜ਼ਾਦੀ ਦਾ ਹੱਕ ਪੁਲਸ ਅਤੇ ਫੌਜ ਦੇ ਬੂਟਾਂ ਹੇਠ ਦਰੜਿਆ !!

ਇਸ ਸਾਲ ਮਾਰਚ ਦੇ ਮਹੀਨੇ 'ਚ ਤਿੰਨ ਮਹਤੱਵਪੂਰਨ ਅਦਾਲਤੀ ਫੈਸਲੇ ਆਏ ਹਨ ਜਿਹਾਂ ਦੀਆਂ ਜਮਹੂਰੀ ਹੱਕਾਂ ਦੀ ਲਹਿਰ ਲਈ ਬੇਹੱਦ ਖਤਰਨਾਕ ਅਰਥ ਸੰਭਵਾਨਾਵਾਂ ਹਨ। ਇਹਨਾਂ ਫੈਸਲਿਆਂ ਵਿੱਚ ਸਭ ਤੋਂ ਪਹਿਲਾ ਮਹਾਰਾਸ਼ਟਰ ਦੇ ਜ਼ਿਲੇ ਗੜ੍ਹਚਿਰੋਲੀ ਦੇ ਸ਼ੈਸ਼ਨ ਅਦਾਲਤ ਵੱਲੋਂ ''ਸਰਕਾਰ ਬਨਾਮ ਮਹੇਸ਼ ਕਰਮੀਨ ਟਿਰਕੀ ਅਤੇ ਹੋਰ'' ਵਿੱਚ ਦਿੱਤਾ ਗਿਆ ਫੈਸਲਾ ਹੈ ਜਿਸ ਵਿੱਚ, ਅਦਾਲਤ ਨੇ ਮਹੇਸ਼ ਟਿਰਕੀ, ਪਾਂਡੂ ਨਰੋਟੇ, ਹੇਮ ਮਿਸ਼ਰਾ, ਪ੍ਰਸ਼ਾਂਤ ਰਾਹੀ ਅਤੇ ਪ੍ਰੋ. ਜੀ.ਐਨ. ਸਾਈਬਾਬਾ ਨੂੰ ''ਗੈਰ ਕਾਨੂੰਨੀ ਕਾਰਵਾਈਆਂ ਰੋਕੂ ਕਾਨੂੰਨ'' ਦੀਆਂ ਵੱਖ ਵੱਖ ਧਾਰਾਵਾਂ ਤਹਿਤ ਉਮਰ ਕੈਦ ਅਤੇ ਵਿਜੈ ਟਿਰਕੀ ਨੂੰ 10 ਸਾਲ ਦੀ ਕੈਦ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਹੈ।

ਦੂਜਾ ਕੇਸ ਮਾਰੂਤੀ-ਸੁਜੂਕੀ ਕੰਪਨੀ ਦੇ ਮਾਨੇਸਰ ਪਲਾਂਟ ਦੇ ਮਜ਼ਦੂਰਾਂ ਨਾਲ ਸਬੰਧਤ ਹੈ ਜਿਸ ਵਿੱਚ ਗੁੜਗਾਉਂ ਦੀ ਅਦਾਲਤ ਨੇ 13 ਮਜ਼ਦੂਰਾਂ ਨੂੰ ਉਮਰਕੈਦ, ਅਤੇ 18 ਮਜ਼ਦੂਰਾਂ ਨੂੰ ਤਿੰਨ ਤੋਂ ਪੰਜ ਸਾਲ ਤੱਕ ਦੀ ਕੈਦ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਹੈ।

ਤੀਜਾ, ਕੇਸ ਅਜਮੇਰ ਸ਼ਰੀਫ ਦਰਗਾਹ ਵਿੱਚ ਹੋਏ ਬੰਬ ਧਮਾਕੇ ਨਾਲ ਸਬੰਧਤ ਹੈ ਜਿਸ ਵਿੱਚ ਹਿੰਦੁਤਵੀ ਦਹਿਸ਼ਤੀ ਸੰਗਠਨਾਂ ਨਾਲ ਸਬੰਧਤ ਤਿੰਨ ਆਗੂਆਂ ਨੂੰ ਉਮਰ ਕੈਦ ਦੀ ਸਜ਼ਾ ਦਿੱਤੀ ਗਈ ਹੈ ਪਰ ਇਸ ਕਾਰੇ ਲਈ ਮੁੱਖ ਦੋਸ਼ੀ – ਮਹੰਤ ਅਸੀਮਾਨੰਦ ਨੂੰ, ਅਦਾਲਤ ਵਿੱਚ ਦਿੱਤੇ ਇਕਬਾਲੀਆ ਬਿਆਨ ਦੇ ਬਾਵਜੂਦ ਬਰੀ ਕਰ ਦਿੱਤਾ ਗਿਆ ਹੈ।

ਗੜ੍ਹਚਿਰੋਲੀ ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ: 

ਸੰਘਰਸ਼ ਕਰ ਰਹੇ ਲੋਕਾਂ ਅਤੇ ਉਹਨਾਂ ਦੇ ਹਿਮਾਇਤੀਆਂ ਲਈ ਖਤਰੇ ਦੀ ਘੰਟੀ

ਗੜ੍ਹਚਿਰੋਲੀ ਦੀ ਅਦਾਲਤ ਵੱਲੋਂ ਜਿਨ੍ਹਾਂ 6 ਕਾਰਕੁਨਾਂ ਨੂੰ ਸਜ਼ਾ ਸੁਣਾਈ ਗਈ ਹੈ, ਉਨ੍ਹਾਂ 'ਚ ਸਿਆਸੀ ਕੈਦੀਆਂ ਦੀ ਰਿਹਾਈ ਲਈ ਜੂਝ ਰਿਹਾ ਪੱਤਰਕਾਰ ਪ੍ਰਸ਼ਾਂਤ ਰਾਹੀ, ਸਭਿਆਚਾਰਕ ਕਾਰਕੁਨ ਅਤੇ ਦਿੱਲੀ ਯੂਨੀਵਰਸਿਟੀ ਦਾ ਵਿਦਿਆਰਥੀ ਹੇਮ ਮਿਸ਼ਰਾ, ਆਪਰੇਸ਼ਨ ਗ੍ਰੀਨ ਹੰਟ ਦੀ ਮਾਰ ਹੇਠ ਆਏ ਸੂਬਿਆਂ 'ਚ ਕਬਾਇਲੀ ਲੋਕਾਂ ਦੇ ਹੱਕ 'ਚ ਆਵਾਜ਼ ਬੁਲੰਦ ਕਰਨ ਵਾਲਾ ਦਿੱਲੀ ਯੂਨੀਵਰਸਿਟੀ ਦਾ ਪ੍ਰੋ. ਜੀ.ਐਨ. ਸਾਈਬਾਬਾ ਅਤੇ ਤਿੰਨ ਕਬਾਇਲੀ ਕਾਰਕੁਨ ਸ਼ਾਮਲ ਹਨ। ਇਨ੍ਹਾਂ ਸਾਰਿਆਂ 'ਤੇ ਸੀ. ਪੀ. ਆਈ. (ਮਾਓਵਾਦੀ) ਦੀ ਕਥਿਤ ਫਰੰਟ ਜਥੇਬੰਦੀ – “ਇਨਕਲਾਬੀ ਜਮਹੂਰੀ ਫਰੰਟ'' 'ਚ ਸ਼ਾਮਲ ਹੋਣ, ਅਤੇ ''ਗੈਰ-ਕਾਨੂੰਨੀਂ ਦਹਿਸ਼ਤਗਰਦ ਕਾਰਵਾਈਆਂ'', ਕਰਨ ਦੇ ਦੋਸ਼ ਲਾਏ ਗਏ ਹਨ। ਇਹ ਫੈਸਲਾ, ਨਿਆਂ ਦੇ ਸਥਾਪਤ ਤੇ ਪ੍ਰਵਾਨਤ ਮਿਆਰਾਂ ਅਨੁਸਾਰ ਇੱਕ-ਪਾਸੜ ਅਤੇ ਨਿਆਂ ਦੀ ਆਤਮਾ ਨੂੰ ਵਲੂੰਧਰਨ ਵਾਲਾ ਹੈ। ਇਹ ਫੈਸਲਾ ਕਰਨ ਸਮੇਂ ਅਦਾਲਤ ਨੇ ਫੌਜਦਾਰੀ ਨਿਆਂ ਦੇ ਸਾਰੇ ਸਥਾਪਤ ਅਸੂਲਾਂ - ਜੋ ਦੋਸ਼ ਸਿੱਧ ਕਰਨ ਲਈ ਪੇਸ਼ ਕੀਤੇ ਸਬੂਤਾਂ ਦੀ ਪਰਖ, ਪੁਲਸ ਦੇ ਸਿਰ ਬਿਨਾਂ ਕਿਸੇ ਸ਼ੱਕ-ਸ਼ੁਭਾ ਤੋਂ ਦੋਸ਼ ਸਿੱਧ ਕਰਨ ਦੀ ਮੁਕੰਮਲ ਜ਼ਿੰਮੇਵਾਰੀ, ਪੁਲਸ ਹਿਰਾਸਤ 'ਚ ਦਿੱਤੇ ਇਕਬਾਲੀਆ ਬਿਆਨ ਦੀ ਭਰੋਸੇਯੋਗਤਾ ਨੂੰ ਅੰਗਣ ਦੇ ਪ੍ਰਚਲਿਤ ਮਿਆਰਾਂ, ਮੁਕੱਦਮੇ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਕੁਦਰਤੀ ਇਨਸਾਫ ਦੇ ਨਿਯਮਾਂ ਦੀ ਸਖਤੀ ਨਾਲ ਪਾਲਣਾ ਕਰਦਿਆਂ ਦੋਸ਼ੀ ਨੂੰ ਆਪਣੇ ਬਚਾਅ ਦਾ ਪੂਰਾ ਮੌਕਾ ਦੇਣ ਆਦਿ, ਦੀ ਨੰਗੀ ਚਿੱਟੀ ਖਿਲਾਫ਼ ਵਰਜੀ ਕੀਤੀ ਹੈ। ਉੱਚ-ਅਦਾਲਤ ਵੱਲੋਂ ਨਿਰਧਾਰਤ ਮਾਪ-ਦੰਡਾਂ ਅਤੇ ਦਿਸ਼ਾ ਨਿਰਦੇਸ਼ਾਂ ਨੂੰ ਟਿੱਚ ਕਰ ਕੇ ਜਾਣਿਆ ਹੈ ਅਤੇ ਪੁਲਸ ਦੀ ਕਹਾਣੀ ਨੂੰ ਬਿਨਾਂ ਕਿਸੇ ਪੁਖਤਾ ਸਬੂਤ ਦੇ, ਹੂਬਹੂ ਪ੍ਰਵਾਨ ਕਰਦਿਆਂ ਇਹਨਾਂ ਸਾਰੇ ਵਿਅਕਤੀਆਂ ਨੂੰ ਸਾਰੇ ਦੋਸ਼ਾਂ 'ਚ ਹੀ ਦੋਸ਼ੀ ਮੰਨ ਕੇ, ਹਰੇਕ ਦੋਸ਼ ਲਈ ਨਿਰਧਾਰਤ ਵੱਧ ਤੋਂ ਵੱਧ ਸਜ਼ਾ ਦਿੱਤੀ ਹੈ।

Ø ਇਸ ਫੈਸਲੇ ਵਿਚ ਇਕ ਫਰਜ਼ੀ ਦਸਤਾਵੇਜ਼ ਦੇ ਆਧਾਰ 'ਤੇ ਤਹਿ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਗੜ੍ਹਚਿਰੋਲੀ ਦੇ ਇਲਾਕੇ 'ਚ ਘੁੰਮ ਰਹੇ ਕਿਸੇ ਵੀ ਵਿਅਕਤੀ ਕੋਲੇ ਕੇਲੇ, ਛਤਰੀ ਅਤੇ ਦੈਨਿਕ ਭਾਸਕਰ ਅਖਬਾਰ ਹੋਣਾ, ਉਸ ਦੇ ਮਾਓਵਾਦੀ ਹੋਣ ਦਾ ਸਿੱਧਾ ਸਬੂਤ ਹੈ ਅਤੇ ਇਹ 'ਸਬੂਤ' ਸਬੰਧਤ ਵਿਅਕਤੀ ਨੂੰ ''ਗੈਰ ਕਾਨੂੰਨੀ ਸਰਗਰਮੀਆਂ ਰੋਕੂ ਕਾਨੂੰਨ'' ਤਹਿਤ ਉਮਰ ਕੈਦ ਦੀ ਸਜ਼ਾ ਦੇਣ ਲਈ ਕਾਫੀ ਹੈ।

Ø ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਇੱਕ ਫੈਸਲੇ ਅਨੁਸਾਰ ''ਗੈਰ ਕਾਨੂੰਨੀ ਸਰਗਰਮੀਆਂ ਰੋਕੂ ਕਾਨੂੰਨ'' ਤਹਿਤ ਕਿਸੇ ਵਿਅਕਤੀ ਨੂੰ ਸਜ਼ਾ ਦੇਣ ਲਈ ਜ਼ਰੂਰੀ ਹੈ ਕਿ ਜਿਸ ਪਾਬੰਦੀਸ਼ੁਦਾ ਜਥੇਬੰਦੀ ਦਾ ਉਹ ਮੈਂਬਰ ਹੈ, ਉਹ ਹਿੰਸਕ ਦਹਿਸ਼ਤੀ ਸਰਗਰਮੀਆਂ 'ਚ ਸ਼ਾਮਲ ਹੋਵੇ ਅਤੇ ਸਬੰਧਤ ਵਿਅਕਤੀ ਨੇ ਖੁਦ ਵੀ ਹਿੰਸਕ ਦਹਿਸ਼ਤੀ ਸਰਗਰਮੀਅ 'ਚ ਹਿੱਸਾ ਲਿਆ ਹੋਵੇ। ਇਸ ਕੇਸ'ਚ ਦੋਸ਼ੀ ਐਲਾਨੇ ਕਿਸੇ ਵੀ ਵਿਅਕਤੀ ਖਿਲਾਫ਼ ਪੁਲਸ ਵੱਲੋਂ ਉਹਨਾਂ ਦੇ ਹਿੰਸਕ ਕਾਰਵਾਈਆਂ 'ਚ ਸ਼ਾਮਲ ਹੋਣ ਦਾ ਕੋਈ ਵੀ ਸਬੂਤ ਪੇਸ਼ ਨਹੀਂ ਕੀਤਾ ਗਿਆ ਅਤੇ ਇਹ ਗੱਲ ਅਦਾਲਤ ਨੇ ਆਪਣੇ ਫੈਸਲੇ 'ਚ ਖੁਦ ਮੰਨੀ ਹੈ। ਇਸ ਦੇ ਨਾਲ ਹੀ ''ਇਨਕਲਾਬੀ ਜਮਹੂਰੀ ਫਰੰਟ'' ਨਾਂ ਦੀ ਜਥੇਬੰਦੀ – ਜੋ ਮਾਓਵਾਦੀਆਂ ਦੀ ਫਰੰਟ ਜਥੇਬੰਦੀ ਦੱਸੀ ਗਈ ਹੈ, ਦੇ ਵੀ ਕਿਸੇ ਹਿੰਸਕ ਸਰਗਰਮੀ 'ਚ ਸ਼ਾਮਲ ਹੋਣ ਦਾ ਕੋਈ ਸਬੂਤ ਪੇਸ਼ ਨਹੀਂ ਕੀਤਾ ਹੈ। ਪਰ ਇਸ ਦੇ ਬਾਵਜੂਦ ਵੀ ਪੰਜ ਵਿਅਕਤੀਆਂ ਨੂੰ ਉਮਰ ਕੈਦ ਅਤੇ ਇਕ ਨੂੰ ਦਸ ਸਾਲ ਦੀ ਕੈਦ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਗਈ ਹੈ

ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਫੈਸਲੇ ਦੇ ਉਲਟ, ਗੜ੍ਹਚਿਰੋਲੀ ਦੀ ਅਦਾਲਤ ਦੇ ਫੈਸਲੇ ਦੀ ਅਮਲੀ ਅਰਥ-ਸੰਭਾਵਨਾ ਇਹ ਬਣਦੀ ਹੈ ਕਿ ਕਿਸੇ ਵੀ ਅਜੇਹੇ ਵਿਅਕਤੀ ਨੂੰ ''ਗੈਰ ਕਾਨੂੰਨੀ ਸਰਗਰਮੀਆਂ ਰੋਕੂ ਕਾਨੂੰਨ'' ਤਹਿਤ ਉਮਰ ਕੈਦ ਦੀ ਸਜ਼ਾ ਦਿੱਤੀ ਜਾ ਸਕਦੀ ਹੈ :-

1.   ਜਿਸ ਦੇ ਮੋਬਾਇਲ ਫੋਨ, ਕੰਪਿਊਟਰ, ਜਾਂ ਪੈਨ ਡਰਾਇਵ ਵਗੈਰਾ 'ਚ ਨੈਟ ਤੋਂ ਡਾਊਨਲੋਡ ਕਰਕੇ ਮਾਓਵਾਦੀ ਪਾਰਟੀ ਜਾਂ ਇਸ ਨਾਲ ਸਬੰਧਤ ਦੱਸੀ ਜਾਂਦੀ ਕਿਸੇ ਵੀ ਜਥੇਬੰਦੀ ਦਾ ਕੋਈ ਦਸਤਾਵੇਜ਼ ਹੋਵੇ; ਝੂਠੇ ਪੁਲਸ ਮੁਕਾਬਲਿਆਂ 'ਚ ਮਾਰੇ ਗਏ ਜਾਂ ਝੂਠੇ ਕੇਸਾਂ 'ਚ ਉਲਝਾ ਕੇ ਲੰਮੇ ਸਮੇਂ ਤੋਂ ਜੇਲ੍ਹੀਂ ਡੱਕੇ ਲੋਕਾਂ ਦੀ ਸੂਚੀ, ਫੋਟੋਆਂ ਜਾਂ ਲੇਖ ਆਦਿ ਹੋਵੇ;

2.   ਜੋ ਫਾਂਸੀ ਦੀ ਸਜਾ ਦਾ ਵਿਰੋਧ ਕਰਦਾ ਹੋਵੇ - ਖਾਸ ਕਰਕੇ ਮਾਓਵਾਦੀ ਕਾਰਕੁਨਾਂ ਜਾਂ ਕਸ਼ਮੀਰ ਅਤੇ ਉੱਤਰ-ਪੂਰਬੀ ਖਿੱਤੇ 'ਚ ਸੰਘਰਸ਼ ਕਰ ਰਹੇ ਕਾਰਕੁਨਾਂ ਲਈ, ਭਾਵੇਂ ਅਜਿਹੇ ਸਜ਼ਾ ਬਾਅਦ ਵਿੱਚ ਉੱਚ ਅਦਾਲਤਾਂ ਵੱਲੋਂ ਗੈਰ-ਕਾਨੂੰਨੀ ਕਹਿ ਕੇ ਰੱਦ ਕਰ ਦਿੱਤੀ ਗਈ ਹੋਵੇ;

3.   ਜੋ ਵਿਕਾਸ ਪ੍ਰੋਜੈਕਟਾਂ ਦੇ ਨਾਂ ਹੇਠ ਲੋਕਾਂ ਕੋਲੋਂ ਜਲ, ਜੰਗਲ, ਜ਼ਮੀਨਾਂ ਅਤੇ ਖਣਿਜ ਪਦਾਰਬ ਜਬਰੀ ਖੋਹੇ ਜਾਣ, ਲੋਕਾਂ ਦਾ ਉਜਾੜਾ ਰੋਕਣ ਅਤੇ ਉਜੜੇ ਲੋਕਾਂ ਦੇ ਮੁੜ-ਵਸੇਬਾ ਕਰਨ ਲਈ ਆਵਾਜ਼ ਉਠਾਉਂਦਾ ਹੋਵੇ;

4.   ਜੋ ਹਾਕਮਾਂ ਦੇ ਲੋਕ-ਧ੍ਰੋਹੀ ਅਤੇ ਸਾਮਰਾਜ-ਪੱਖੀ 'ਵਿਕਾਸ ਮਾਡਲ' ਦਾ ਵਿਰੋਧ ਕਰਦਾ ਹੋਵੇ। (ਇਸਦੀ ਝਲਕ ਫੈਸਲੇ ਦੇ ਪੈਰਾ ਨੰ: 1013 ਤੋਂ ਮਿਲਦੀ ਹੈ ਜਿਸ ਵਿੱਚ ਅਦਾਲਤ ਵੱਲੋਂ ਸਾਫ ਲਿਖਿਆ ਗਿਆ ਹੈ ਕਿ ਦੋਸ਼ੀਆਂ - ਪ੍ਰੋ ਸਾਈਬਾਬਾ, ਪ੍ਰਸ਼ਾਂਤ ਰਾਹੀ, ਹੇਮ ਮਿਸ਼ਰਾ ਅਤੇ ਤਿੰਨ ਕਬਾਇਲੀ ਕਾਰਕੁਨ ਗੜ੍ਹਚਿਰੋਲੀ ਦੇ 'ਵਿਕਾਸ' 'ਚ ਰੋੜ ਬਣੇ ਹੋਏ ਹਨ। ਉਹ ਮੌਤ ਦੀ ਸਜ਼ਾ ਦੇ ਹੱਕਦਾਰ ਹਨ ਪ੍ਰੰਤੂ ਕਾਨੂੰਨ ਵੱਲੋਂ ਅਦਾਲਤ ਦੇ ਹੱਥ ਬੰਨੇਂ ਹੋਣ ਕਾਰਨ ਉਹਨਾਂ ਨੂੰ ਉਮਰਕੈਦ ਦੀ ਸਜ਼ਾ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ।)

5.   ਜੋ ਲੋਕ-ਹਿਤਾਂ ਲਈ ਸੰਘਰਸ਼ ਕਰ ਰਹੇ ਉਹਨਾਂ ਆਗੂਆਂ ਦੀ ਰਿਹਾਈ ਦੀ ਮੰਗ ਕਰਦਾ ਹੋਵੇ, ਜਿਨ੍ਹਾਂ ਨੂੰ ਹਾਕਮਾਂ ਨੇ ਗੈਰਕਾਨੂੰਨੀ ਅਤੇ ਦਹਿਸ਼ਤਗਰਦੀ ਦੀਆਂ ਸਰਗਰਮੀਆਂ'ਚ ਸ਼ਾਮਲ ਹੋਣ, ਭਾਰਤ ਸਰਕਾਰ ਵਿਰੁੱਧ ਯੁੱਧ ਛੇੜਣ ਜਾਂ ਦੇਸ਼-ਧ੍ਰੋਹ ਵਰਗੇ ਸੰਗੀਨ ਜੁਰਮ ਲਾਕੇ, ਝੂਠੇ ਕੇਸਾਂ 'ਚ ਸਾਲਾਂ-ਬੱਧੀ ਜੇਲ੍ਹਾਂ 'ਚ ਡੱਕਿਆ ਹੋਵੇ।

6.   ਜੋ ਸਿਆਸੀ ਕੈਦੀਆਂ ਦੀ ਰਿਹਾਈ ਜਾਂ ਉਹਨਾਂ ਦੀ ਫਾਂਸੀ ਦੀ ਸਜ਼ਾ ਰੱਦ ਕਰਨ ਸਬੰਧੀ ਹੋਏ ਇਕੱਠਾ, ਸੈਮੀਨਾਰਾਂ, ਕਨਵੈਨਸ਼ਨਾਂ ਆਦਿ 'ਚ 'ਹਮ ਲੜੇਂਗੇ ਸਾਥੀ' ਜਾਂ 'ਲੇ ਮਸ਼ਾਲੇ ਚਲ ਪੜੇ ਹੈਂ ਲੋਕ ਮੇਰੇ ਗਾਓਂ ਕੇ' ਵਰਗੇ ਗੀਤ ਗਾਵੇ ਜਾਂ ਅਜੇਹੇ ਗੀਤ ਗਾਓਣ ਵਾਲਿਆਂ ਟੀਮਾਂ ਵਿੱਚ ਡਫਲੀ ਆਦਿ ਸਾਜ਼ ਵਜਾਵੇ; ਇਹਨਾਂ ਇਕੱਠਾਂ ਦੀਆਂ ਤਸਵੀਰਾਂ ਅਤੇ ਰਿਪੋਰਟਾਂ, ਫੇਸਬੁੱਕ, ਵੱਟਸਐਪ ਅਤੇ ਹੋਰ ਸਮਾਜਿਕ ਮੀਡੀਆ 'ਤੇ ਫੈਲਾਵੇ, ਜਾਂ ਅਜਿਹੇ ਇਕੱਠ ਜਥੇਬੰਦ ਕਰਨ ਵਾਲੇ ਆਗੂਆਂ ਨਾਲ ਸ਼ੋਸ਼ਲ ਮੀਡੀਆ 'ਤੇ ਦੋਸਤੀ ਪਾਵੇ।

7.   ਇੱਥੇ ਇਹ ਦੱਸਣਾ ਜ਼ਰੂਰੀ ਹੈ ਕਿ ਬਹੁਤ ਸਾਰੀਆਂ ਅਖਬਾਰੀ ਰਿਪੋਰਟਾਂ ਅਨੁਸਾਰ ਕੇਂਦਰ ਸਰਕਾਰ ਦੇ ਗ੍ਰਹਿ ਮੰਤਰਾਲੇ ਨੇ “ਜਮਹੂਰੀ ਅਧਿਕਾਰ ਸਭਾ” ਸਮੇਤ ਪੰਜਾਬ ਦੀਆਂ ਕਈ ਹੋਰ ਜਥੇਬੰਦੀਆਂ 'ਤੇ ਮਾਓਵਾਦੀਆਂ ਦੀਆਂ ''ਫਰੰਟ ਜਥੇਬੰਦੀਆਂ'' ਹੋਣ ਦਾ ਝੂਠਾ ਠੱਪਾ ਲਾਇਆ ਹੋਇਆ ਹੈ। ਜਦਕਿ ਹਕੀਕਤ ਇਹ ਹੈ ਕਿ ਸਭਾ ਦਹਾਕਿਆਂ ਤੋਂ ਜਮਹੂਰੀ ਹੱਕਾਂ ਵਾਸਤੇ ਸਰਗਰਮ ਸੰਗਠਨ ਹੈ ਜਿਸ ਵਿਚ ਪੰਜਾਬ ਦੀਆਂ ਬਹੁਤ ਨਾਮਵਰ ਤੇ ਵੱਖ ਵੱਖ ਖੇਤਰਾਂ ਦੀਆਂ ਚਰਚਿਤ ਲੋਕ ਪੱਖੀ ਸ਼ਖਸ਼ੀਅਤਾਂ ਹਿਸਾ ਲੈਂਦੀਆਂ ਰਹੀਆਂ ਹਨ।

ਮਾਰੂਤੀ-ਸੁਜ਼ੂਕੀ ਦੇ ਕਾਮਿਆਂ ਬਾਰੇ ਗੁੜਗਾਓਂ ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ:

ਕਿਰਤੀ ਵਿਰੋਧੀ ਫੈਸਲਿਆਂ ਦੀ ਲੜੀ ਦਾ ਹਿੱਸਾ  

ਗੁੜਗਾਓਂ ਦੀ ਅਦਾਲਤ ਵੱਲੋਂ ਮਾਰੂਤੀ-ਸੁਜ਼ੂਕੀ ਕੰਪਨੀ ਦੇ 13 ਮਜ਼ਦੂਰਾਂ ਜਿਸ ਵਿੱਚ ਯੂਨੀਅਨ ਬਾਡੀ ਦੇ 12 ਮੈੰਬਰ ਸ਼ਾਮਿਲ ਹਨ ਨੂੰ ਕਤਲ ਦੇ ਝੂਠੇ ਦੋਸ਼ ਹੇਠ 18 ਮਾਰਚ ਨੂੰ ਉਮਰ ਕੈਦ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਗਈ। ਇਸ ਤੋਂ ਬਿਨਾਂ 4 ਮਜਦੂਰਾਂ ਨੂੰ 5 ਸਾਲ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਗਈ ਤੇ 14 ਮਜਦੂਰਾਂ ਨੂੰ ਤਿੰਨ ਸਾਲ ਦੀ ਸਜ਼ਾ ਹੋਈ। ਜਿਹਨਾਂ ਮਜ਼ਦੂਰਾਂ ਨੂੰ ਤਿੰਨ ਸਾਲ ਦੀ ਸਜਾ ਹੋਈ ਹੈ ਉਹ ਪਹਿਲਾਂ ਹੀ ਚਾਰ ਸਾਲ ਜੇਲ੍ਹ 'ਚ ਗੁਜਾਰ ਚੁਕੇ ਸੀ ਜਿਸ ਕਾਰਣ ਉਹਨਾਂ ਨੂੰ ਰਿਹਾਅ ਕਰ ਦਿੱਤਾ ਗਿਆ। ਇਸ ਫੈਸਲੇ ਰਾਹੀਂ 117 ਮਜਦੂਰਾਂ ਨੂੰ ਬਰੀ ਕੀਤਾ ਗਿਆ ਜਿਹੜੇ ਕਰੀਬ 4 ਸਾਲ ਜੇਲ੍ਹ ‘ਚ ਗੁਜਾਰ ਚੁੱਕੇ ਸੀ,ਕੋਈ ਨਹੀਂ ਜਾਣਦਾ ਉਹਨਾਂ ਸਾਲਾਂ ਦਾ ਹਿਸਾਬ ਕੌਣ ਦੇਵੇਗਾ।148 ਮਜਦੂਰ ਲਗਭਗ 2012 ਤੋਂ ਬਿਨਾਂ ਜਮਾਨਤ ਚਾਰ ਸਾਲ ਤੱਕ ਜੇਲ੍ਹ ਚ ਰਹੇ ਅਤੇ 2500ਮਜਦੂਰਾਂ ਨੂੰ ਗੈਰ-ਕਾਨੂੰਨੀ ਤਰੀਕੇ ਨਾਲ ਬਰਖਾਸਤ ਕਰ ਦਿੱਤਾ ਗਿਆ ਤੇ ਲਗਾਤਾਰ ਰਾਜ-ਸੱਤਾ ਦੇ ਦਮਨ ਦਾ ਸਾਹਮਣਾ ਕਰਨਾ ਪਿਆ। ਮਰੂਤੀ ਸਜੂਕੀ ਦੇ ਕਾਮਿਆਂ ਨਾਲ ਸਰਕਾਰ ਤੇ ਹਕੂਮਤੀ ਤਾਣੇ-ਬਾਣੇ ਵਲੋਂ ਕੀਤੀਆਂ ਵਧੀਕੀਆਂ, ਸਰਕਾਰ ਦੀਆਂ ਉਹਨਾਂ ਨੀਤੀਆਂ ਦੀ ਹੀ ਕੜੀ ਹੈ ਜਿਨ੍ਹਾਂ ਦੇ ਤਹਿਤ ਦੇਸੀ-ਬਦੇਸ਼ੀ ਸ਼ਾਹੂਕਾਰਾਂ ਨੂੰ ਮੁਲਕ ਦੇ ਮਾਲ-ਖਜ਼ਾਨੇ ਅਤੇ ਕਿਰਤ ਦੀ ਅੰਨੀਂ ਲੁੱਟ ਕਰਨ ਦੀ ਖੁੱਲ੍ਹ ਦਿੱਤੀ ਜਾ ਰਹੀ ਹੈ ਅਤੇ ਕਿਰਤੀਆਂ ਦੇ ਜਥੇਬੰਦ ਹੋਕੇ ਸੰਘਰਸ਼ ਕਰਨ ਦੇ ਅਧਿਕਾਰਾਂ ਨੂੰ ਦਰੜਿਆ ਜਾ ਰਿਹਾ ਹੈ। ਇਹ ਸਿਲਸਿਲਾ ਕਈ ਸਾਲਾਂ ਤੋਂ ਚੱਲ ਰਿਹਾ ਹੈ। ਇਸ ਦੇ ਤਹਿਤ ਪਹਿਲਾਂ ਲੁਧਿਆਣੇ ਦੇ ਵੀਰਗਾਰਮੈਂਟਸ ਅਤੇ ਡੀ.ਐਮ.ਸੀ. ਹਸਪਤਾਲ ਦੇ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਕੈਦ ਦੀਆਂ ਸਜ਼ਾਵਾਂ ਸੁਣਾਈਆਂ ਗਈਆਂ ਸਨ। ਇਸ ਤੋਂ ਬਾਦ ਕੋਇੰਬਟੂਰ 'ਚ ਪ੍ਰਾਈਕੋਲ, ਸੂਰਜਪੁਰ 'ਚ ਗਰਾਜੀਆਨੋ ਅਤੇ ਯਨਮ (ਪਾਂਡੀਚੇਰੀ) 'ਚ ਰੀਜੈਂਸੀ ਸੈਰੇਮਿਕ ਦੇ ਮਜ਼ਦੂਰਾਂ ਨੂੰ ਭਾਰੀ ਸਜਾਵਾਂ ਦਿੱਤੀਆਂ ਗਈਆਂ। ਇਕ ਪਾਸੇ ਸਰਕਾਰ ਵੱਲੋਂ ਕਿਰਤੀਆਂ ਦੇ ਕਾਨੂੰਨੀ ਹੱਕਾਂ ਦੀਆਂ ਮਾਲਕਾਂ ਵੱਲੋਂ ਨੰਗੇ-ਚਿੱਟੇ ਰੂਪ 'ਚ ਕੀਤੀਆਂ ਜਾ ਰਹੀਆਂ ਉਲੰਘਣਾਵਾਂ ਦਾ ਕੋਈ ਨੋਟਿਸ ਨਹੀਂ ਲਿਆ ਜਾ ਰਿਹਾ, ਦੂਜੇ ਪਾਸੇ ਆਪਣੇ ਹੱਕਾਂ ਲਈ ਸੰਘਰਸ਼ਾਂ ਦੇ ਰਾਹ ਪਏ ਕਿਰਤੀਆਂ ਨੂੰ ਝੂਠੇ ਕੇਸਾਂ 'ਚ ਫਸਾ ਕੇ ਲੰਮੀਆਂ ਕੈਦਾਂ ਦੀਆਂ ਸਜਾਵਾਂ ਦਿਵਾਈਆਂ ਜਾ ਰਹੀਆਂ ਹਨ।

Ø ਮਾਰੂਤੀ-ਸੁਜ਼ੂਕੀ ਕੇਸ 'ਚ ਅਦਾਲਤ ਦਾ ਜਮਾਤੀ ਪੱਖਪਾਤ ਇਸ ਗੱਲੋਂ ਸਪੱਸ਼ਟ ਹੋ ਜਾਂਦਾ ਹੈ ਕਿ ਮਜ਼ਦੂਰਾਂ ਦੇ ਖਿਲਾਫ਼ ਗਵਾਹੀਆਂ ਦੇਣ ਵਾਲੇ ਸਾਰੇ ਵਿਅਕਤੀ ਮਾਲਕਾਂ ਦੇ ਅਧਿਕਾਰੀ ਜਾਂ ਪੁਲਸ ਕਰਮਚਾਰੀ ਸਨ। ਜਦੋਂ ਬਚਾਅ-ਪੱਖ ਨੇ ਉਹਨਾਂ ਦੀ ਗਵਾਹੀ ਨੂੰ ਜਮਾਤੀ ਇੱਕ-ਪਾਸੜਪੁਣੇਂ (Class prejudice) ਦੇ ਆਧਾਰ 'ਤੇ ਰੱਦ ਕਰਨ ਦੀ ਦਲੀਲ ਦਿੱਤੀ ਤਾਂ ਅਦਾਲਤ ਨੇ ਨੇ ਕਿਹਾ ਕਿ ਇਸਨੂੰ ਪ੍ਰਵਾਨ ਨਹੀਂ ਕੀਤਾ। ਪਰ ਦੂਜੇ ਪਾਸੇ ਜਦੋਂ ਬਚਾਅ ਪੱਖ ਨੇ ਕੇਸ ਦੀ ਤਫਤੀਸ਼ ਤੇ ਸੁਆਲ ਉਠਾਉਂਦਿਆਂ ਇਹ ਦਲੀਲ ਉਭਾਰੀ ਕਿ ਤਫਤੀਸ਼ ਦੌਰਾਨ ਪੁਲਸ ਨੇ ਉਹਨਾਂ ਮਜ਼ਦੂਰਾਂ ਦੇ ਬਿਆਨ ਨਹੀਂ ਲਿਖੇ ਜੋ ਘਟਨਾ ਸਮੇਂ ਮੌਕੇ 'ਤੇ ਮੌਜੂਦ ਸਨ ਅਤੇ ਵਾਕੇ 'ਚ ਸ਼ਾਮਲ ਨਹੀਂ ਸਨ ਤਾਂ ਅਦਾਲਤ ਨੇ ਇਸਨੂੰ ਇਸ ਆਧਾਰ 'ਤੇ ਰੱਦ ਕਰ ਦਿੱਤਾ ਕਿ ਉਹਨਾਂ ਕਿਰਤੀਆਂ ਨੇ ਯੂਨੀਅਨ ਦੇ ਮੈਂਬਰ ਹੋਣ ਕਾਰਨ ਆਪਣੇ ਸਾਥੀਆਂ ਦੇ ਹੱਕ 'ਚ ਹੀ ਬਿਆਨ ਦੇਣੇਂ ਸਨ। ਜੇ ਯੂਨੀਅਨ ਦੇ ਮੈਂਬਰ ਹੋਣ ਕਾਰਨ ਕਿਰਤੀਆਂ ਦੀ ਗਵਾਹੀ ਨੂੰ ਜਮਾਤੀ ਨਜ਼ਰੀਏ ਤੋਂ ਪ੍ਰੇਰਤ ਹੋਣ ਦੇ ਆਧਾਰ 'ਤੇ ਰੱਦ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ ਤਾਂ ਮਾਲਕਾਂ ਅਧੀਨ ਕੰਮ ਕਰ ਰਹੇ ਅਧਿਕਾਰੀਆਂ ਦੀ ਗਵਾਹੀ 'ਤੇ ਜਮਾਤੀ ਨਜ਼ਰੀਏ ਦਾ ਮਾਪ-ਦੰਡ ਕਿਉਂ ਨਹੀਂ ਲਾਗੂ ਕੀਤਾ ਗਿਆ? ਸਭਾ ਸਮਝਦੀ ਹੈ ਕਿ ਦਰਅਸਲ ਮਰੂਤੀ ਸਜੂਕੀ ਦੇ ਉਕਤ ਅਤੇ ਪਹਿਲਾਂ ਤੋਂ ਮਜ਼ਦੂਰਾਂ ਖਿਲਾਫ ਆਏ ਹੋਰ ਫੈਸਲਿਆਂ ਰਾਹੀਂ ਪੁਲਸ ਅਤੇ ਨਿਆਂਇਕ ਪ੍ਰਬੰਧਵੱਲੋਂ ਦੇਸੀ-ਵਿਦੇਸ਼ੀ ਸ਼ਾਹੂਕਾਰਾਂ ਦੇ ਹਿੱਤਾਂ ਦੀ ਰਾਖੀ ਕੀਤੀ ਜਾ ਰਹੀ ਹੈ ਅਤੇ ਫੌਜਦਾਰੀ ਨਿਆਂ ਪ੍ਰਣਾਲੀ ਨੂੰ ਕਿਰਤੀਆਂ ਦੇ ਸੰਘਰਸ਼ਾਂ ਅਤੇ ਵਿਰੋਧ ਨੂੰ ਝੂਠੇ ਕੇਸਾਂ 'ਚ ਉਲਝਾਕੇ ਅਤੇ ਸਖਤ ਸਜ਼ਾਵਾਂ ਦੇ ਕੇ ਕੁਚਲ ਦੇਣ ਲਈ ਵਰਤਿਆ ਜਾ ਰਿਹਾ ਹੈ।

ਅਜਮੇਰ ਸ਼ਰੀਫ ਦਰਗਾਹ, ਮੱਕਾ ਮਸਜਿਦ ਅਤੇ ਸਮਝੌਤਾ ਐਕਸਪ੍ਰੈਸ 'ਚ ਬੰਬ ਧਮਾਕਿਆਂ ਨਾਲ ਸਬੰਧਤ ਕੇਸਾਂ ‘ਚ ਝਲਕਦਾ ਪਖਪਾਤੀ ਰਵਈਆ: 

ਉਕਤ ਸਾਰੇ ਕੇਸਾਂ 'ਚ ਸਰਕਾਰ, ਪ੍ਰਸ਼ਾਸਨਕਿ ਤੇ ਨਿਆਂਇਕ ਪ੍ਰਬੰਧ ਦਾ ਰਵੱਈਆ ਮੁਜਰਮਾਂ ਦਾ ਪੱਖ ਪੂਰਨ ਵਾਲਾ ਜਾਹਰ ਹੋਇਆ ਹੈ ਕਿਉਂਕਿ ਸਾਰੇ ਦੇ ਸਾਰੇ ਮੁਜਰਮ ਹਿੰਦੂਤਵੀਫਿਰਕੂ ਫਾਸ਼ੀ ਦਹਿਸ਼ਤੀ ਗ੍ਰੋਹਾਂ ਨਾਲ ਸਬੰਧਤ ਸਨ। ਅਸੀਮਾਨੰਦ ਅਤੇ ਹੋਰ ਗਵਾਹਾਂ ਦੇ ਇਕਬਾਲੀਆ ਬਿਆਨਾਂ ਅਤੇ ਤਫਤੀਸ਼ ਦੌਰਾਨ ਇਕੱਠੇ ਕੀਤੇ ਸਬੂਤਾਂ ਤੋਂ ਇਹ ਸਾਫ ਹੋ ਗਿਆ ਸੀ ਕਿ ਆਰ.ਐਸ.ਐਸ. ਦੇ ਸਿੱਧੇ ਥਾਪੜੇ ਨਾਲ 'ਅਭਿਨਵ ਭਾਰਤ' ਨਾਂ ਦੀ ਜਥੇਬੰਦੀ ਦਹਿਸ਼ਤਗਰਦ ਕਾਰਵਾਈਆਂ 'ਚ ਲੱਗੀ ਹੋਈ ਸੀ ਅਤੇ ਉਸਨੇ ਉਪਰੋਕਤ ਸਾਰੇ ਬੰਬ ਧਮਾਕੇ ਕਰਕੇ ਲਗਭਗ 100 ਵਿਅਕਤੀਆਂ ਨੂੰ ਮੌਤ ਦੇ ਘਾਟ ਉਤਾਰ ਦਿਤਾ ਗਿਆ। ਪਰ ਇਸ ਜਥੇਬੰਦੀ ਨੂੰ ਸਰਕਾਰ ਨੇ ਗੈਰਕਾਨੂੰਨੀ ਜਾਂ ਦਹਿਸ਼ਤਗਰਦ ਨਹੀਂ ਐਲਾਨਿਆ। ਜਦੋਂ ਇਕਬਾਲੀਆ ਬਿਆਨ ਦੇਣ ਵਾਲੇ ਗਵਾਹਾਂ ਨੇ ਆਰ.ਐਸ.ਐਸ. ਦੇ ਮੁਖੀ ਮੋਹਨ ਭਾਗਵਤ ਅਤੇ ਹੁਣ ਉਤਰਪ੍ਰਦੇਸ਼ ਦੇ ਮੁੱਖ ਮੰਤਰੀ ਬਣੇ ਯੋਗੀ ਅਦਿੱਤਯਨਾਥ ਦੇ ਨਾਂ ਲੈਣੇ ਸ਼ੁਰੂ ਕਰ ਦਿੱਤੇ ਤਾਂ ਤਫਤੀਸ਼ ਬੰਦ ਕਰ ਦਿੱਤੀ ਗਈ। ਇਹਨਾਂ ਸਾਰੇ ਗਵਾਹਾਂ ਦੇ ਇਕਬਾਲੀਆਂ ਬਿਆਨਾਂ ਨੂੰ ਵੀ ਬਿਨਾਂ ਕਿਸੇ ਠੋਸ ਕਾਰਨ ਦੇ ਨਜ਼ਰ ਅੰਦਾਜ ਕਰ ਦਿੱਤਾ ਗਿਆ। ਅਜਿਹੇ ਮੁਜਰਮਾਂ ਨੂੰ ਮੁਹਈਆ ਨਿਆਂਇਕ ਸੁਰਖਿਆ ਛਤਰੀ ਰਾਹੀਂ ਭਗਵੀਂ ਫਿਰਕਾਪ੍ਰਸਤੀ ਨੂੰ ਹਵਾ ਦਿਤੀ ਜਾ ਰਹੀ ਹੈ।

OPPOSE ARREST & TORTURE OF COM. HARBHINDER JALAL, DEMAND AN END TO ALL REPRESSIVE MEASURES

COM. HARBHINDER JALAL, BEING PRODUCED BY POLICE IN KHARAR COURT

Harbhinder Singh Jalal, who has been editing a revolutionary Punjabi magazine “CHAMKDA LAL TARA” (Shining Red Star), was arrested by Kharar Police while he was traveling in a bus near Gharuan village. The police alleged him to be the head of Punjab unit of CPI Maoist. A 32 bore pistol and some live cartridges were shown to have been recovered from him.

In police custody Harbhinder was severely tortured and subjected to third degree methods of interrogation. A case under S.10,13,18 & 20 of Unlawful Activities (Prevention) Act; S. 25, 54, 59 of the Arms Act and Section 121, 419, 420, 471 of the IPC has been slapped against him. He was denied the legal assistance of his chosen lawyers. Lok Morcha Punjab, along with his family approached S/Sh. R.S. Bains and Harinder Pal Singh Ishar, Chandigarh based Human Rights lawyers, who moved an application for permission to meet Com Harbhinder in police custody and for his medical examination. The State vigorously opposed this application on the fictitious ground of threat to national security. However the court allowed the advocates to meet him daily in the Police Station between 7 PM to 8 PM and also to get him medically examined every 48 hours from the Civil Hospital.

On 9.5.2011, when Com Harbhinder was produced in court for further remand, dozens of his friends and well-wishers from all over Punjab, came to see him, but the police did not allow them to meet him. His further police remand was sought on the plea that he was to be taken to Ranchi to affect certain recoveries. Subsequently this pretext proved to be false as he was not taken to Ranchi. Perhaps the court’s order permitting his lawyers to meet him everyday in the extended period of remand, acted as a dampener for the police. On 14.5.2011, he was remanded to judicial custody and is now lodged in Ropar Jail.

On 6.5.2011, a heavy contingent of Ropar and Bathinda Police raided his house at Rampura. Finding it locked, the police tried to find its keys from the neighbors, abusing, threatening and misbehaving with them. The people however refused to be cowed down and did not allow the police to search his house in the absence of any of his family members. To terrorize the people, the police raided the houses of two trade unionists living in the locality. Next day, the police party again came early in the morning along with some Municipal Councilors of Rampura City and forcibly entered in and searched Harbhinder’s house in the absence of his family members and any person from the locality. The police took away a computer, a large number of books and some domestic articles. This move was strongly opposed by the democratic mass organizations of the area. Next day a strongly worded statement denouncing the terror tactics of the police was issued jointly by the Bharti Kisan Union ( Dakonda), Technical Services Union, Democratic Teachers Front, and B.K.U. (Ugrahan).

Lok Morcha Punjab, Democratic Front Against Operation Green Hunt Punjab, and a revolutionary paper SURAKH REKHA condemned the arrest and false implication of Harbhinder Jalal in a criminal case. To keep the people informed about this, we utilized the medium of Facebook by posting news items and press statements on it. Now the DFAOGH Punjab has decided to hold Conventions at Chandigarh and Rampura on this issue along with the repressive measures taken at village Selbrah and Kotra Kaurian Wala, against the people opposing opening of liquor vends.

The planting of 32 bore revolver and live cartridges on Harbhinder Jalal, seems to be a part of the Punjab Police’s crude attempt to discredit revolutionary democratic movement in Punjab. Recently the police unearthed a gang of serving police employees and Arms Dealers, supplying country made illicit arms as genuine, by putting fake stamps and markings of reputed arms companies on them. As many as 8 police employees serving in various districts of Punjab have been arrested. The DGP Punjab, with the aid of certain pliable press persons, has been trying to link it with the Maoists, although up till now, no such proof is forthcoming.

Lok Morcha Punjab views the arrest of Com Harbhinder; falsely charging him with unlawful activities, waging war against the Govt, forgery and cheating; subjecting him to third degree torture, and illegal raids at his house and the houses of other trade unionists at Rampura, as atrocious, totally illegal and undemocratic steps, deserving strongest condemnation. These steps are aimed at stifling the political dissent, and ruthlessly crushing of every attempt to organize the people against the policies of liberalization, globalization and privatization, being pursued by the anti-people and anti-national rulers to ensure super profits for the MNCs and their Indian agents, through unhindered exploitation of our rich natural resources. We call upon all democratic people to join us in demanding withdrawal of the criminal case registered against Com Harbhinder Jalal and his unconditional release; putting an end to all repressive measures initiated against revolutionary political and mass activists and the people; and complete halt to neo-liberal economic policies.

Whose handiwork is Gnaneshwari Express Mishap?

CPI (Maoist) and PCAPA deny any involvement

Statement from the Revolutionary Democratic Front (RDF):

Yesterday's( 28 May 2010) Gnaneshwari Express and a goods train tragedy near Kharagpur in West Bengal in which 80 people were killed and 200 injured was attributed to CPI(Maoist) and Peoples Committee Against Police Atrocities (PCAPA) by the media. The media unscrupulously played false news stories blaming CPI (Maoist) and Peoples Committee for two days. Some political parties like Trinomial Congress and the ruling CPI(Marxist) also blamed these organisations without any verification. Significantly Union Home Minister P. Chidambaram has declined to attribute the blame on the CPI (Maoist) and also announced that there was no evidence of any bomb blast in the incident.

The Union Home Minister has ordered an enquiry to find out any possibility of sabotage. During the day the leaders of CPI (Maoist) clarified through a long statement that they were not responsible for the train tragedy and condemned any possible sabotage work if any force involved behind the incident. They have also expressed their condolences for the families of deceased. The PCAPA also clarified that their activists are not involved in this incident. They suspected the ruling CPI(Marxist) to have been involved in the sabotage desperately trying to tilt the public opinion against the fighting forces.

Purposefully the media did not cover the statement issued by the CPI (Maoist) while playing the false stories and commentaries blaming the CPI (Maoist) for the incident. Some all India newspapers like The Hindu wrote editorials blaming the CPI (Maoist) for the incident. Many other newspapers wrote major articles decrying the CPI (Maoist) as terrorist attributing the blame on them. Now when the clarifications come from CPI (Maoist) and PCAPA, will these media houses withdraw their false stories and give the facts to the people? Will they regret for propagating the false news?

These two days of false propaganda is made with a malicious intension of maligning the CPI (Maoist) and PCAPA.

I attach here news reports covering the statement of clarification from the CPI (Maoist) and PCAPA by a section of newspapers in West Bengal. The same newspaper didn't cover it in their editions coming from all other cities.

Statement on Train(Jnaneswari Express) accident by the Maoists

The following report was published in the Bengali Ananda Bazar Patrike dt. 29 May 2010, page 7, Kolkata edition. It bore the caption 'Denying allegations about their involvement, the Maoists demand enquiry' and written by Prasun Acharyya. The statement was issued in the name of Aakash, the Maoist WB State Committee leader.

On Friday night, the following statement was issued on behalf of the CPI(Maoist) WB State Committee. "We are in no way involved in this incident. We did not carry out any explosion in the railway line. Killing innocent people by sabotaging railway line is not our agenda. When we carry out any action, there are always some specific reasons behind. We also acknowledge responsibility for that. Whenever we commit mistakes we admit it. However, responsibility is being placed on us now for an incident in which we are in no way involved". Accusing the CPI(Marxist) of putting blame on them the Maoists said "The CPI(M) is haunted by the prospect of a landslide defeat in the coming municipal elections. Thus they have opted for a strategy of killing two birds with a single stone. On the one hand, attempts are being made to brand us as terrorists and thus isolate us from the people. On the other hand, they are seeking to prove that Mamata Banerjee is completely misfit as the railway minister". The Maoists did not directly state that the CPI(M) was involved in the incident. But what they said is: "In the coming days also such unfortunate incidents can take place in order to malign Mamata and the Maoists". The WB State Committee of the Maoists strongly condemned this act and stated: "This act deserves unequivocal condemnation. We are extending our sympathies to the members of the bereaved families. We also wish the speedy recovery of those who are injured".

Meanwhile, the People's Committee Against Police Atrocities has accused the CPI(M) of being involved in it. In reply to a query, the Maoists said: "We are not accountable for whatever one might say. We are not saying that the CPI(M) was involved in it. Let the railways make enquiry. The members of our party have made investigation after the incident. It was the removal of fish plates that led to the accident. There was no line for one metre stretch, side-clips were open. That led to derailment. Let the railways enquiry why side clips were open at the junction points of rail lines. No explosion took place at the site. Had there been any explosion, stones would have broken up and thrown out. But nothing like it happened".

The Maoists said that whenever any untoward incident takes place along the railway route, the tendency is always to accuse them for such incidents. "Three days back, eleven bogies of the New Delhi -Gwahati Rajdhani Express were derailed near Naogachhia Station in Bihar. It was not a major accident. However, initially the blame was put on us. Later on, it was found that it was the fault of the railways that led to such a mishap".

The Maoists denying responsibility for this mishap, said, "We are not involved in the Sardiha incident, so we take no responsibility of it". The Hindustan Times dt. 29 May 2010 carried only a brief statement from the Maoists: "Killing innocent civilians is not on our agenda. We have no links with this tragic incident, and we sympathise with the families of the deceased and the injured".
