DAMINI IS FORTUNATE TO HAVE DIED, OTHERWISE SHE WOULD HAVE BEEN HAULED UP FOR GANG RAPE.

TILL NOW, WOMEN WERE VICTIMS OF RAPE !
NOW THEY CAN COMMIT RAPE & BE HAULED UP FOR THAT

Our dear daughters, sisters, mothers & wives!
Don’t be meek & submissive!
Don’t feel guilty or ashamed on being raped!
Our law-makers have turned the tide. In future you will not be a victim of rape but a perpetrator of rape – at least in law.

The Criminal Law Amendment Ordinance, 2013, promulgated by the UPA Govt has amended Section 375 of the Indian Penal Code, which defined 'rape'. Earlier a man was said to have committed 'rape', who had sexual intercourse with a woman against her will or consent or with consent obtained under threat, duress or misconception or with or without consent when the woman is under 16 years of age.

Under the amended law, the word ‘rape’ has been substituted by 'sexual assault', which has been made gender neutral. It says:

“A person is said to commit "sexual assault” if that person –
a.   penetrates his penis, to any extent, into the vagina, mouth, urethra or anus of another person or makes the person to do so with him or any other person; or
b.   inserts, to any extent, any object or a part of the body, not being the penis, into the vagina, the urethra or anus of another person or makes the person to do so with him or any other person; or
c.    manipulates any part of the body of another person so as to cause penetration into the vagina, urethra, anus or any part of the body of such person or makes the person to do so with him or any other person; or
d.   applies his mouth to the penis, vagina, anus, urethra of another person or makes such person to do so with him or any other person;
e.    touches the vagina, penis, anus or breast of that person or any other person”
against the other person’s will or without consent, or with consent obtained under fear of death, hurt, intoxication, misconception, or with consent when the other person is under 18 years of age, or unable to communicate consent.

The clear implication of this amendment is that a politically, financially or socially influential person, having good rapprochement with the police can rape a woman and after doing so can register a criminal case against her of having made “sexual assault” against him and get her sentenced to rigorous imprisonment for a term which shall not be less than 7 years and may extend to imprisonment for life and fine.

Damini is fortunate to have died, otherwise she could have been prosecuted for committing gang rape, under the new rape law !
Who says the law is class-neutral?
